in virginia for examination. the blast killed 8 people and destroyed numerous homes. a fifth person has been charged with posing as a victim of that pipeline explosion in order to get help. 51-year-old daniel stansbury of los altos has pled not guilty to seven charges including identity theft and falsely claiming aid. prosecutors say he went to a resource center for blast victims used a false name and said he lived in the crestmoor neighborhood. he then allegedly accepted more than $2,000 in gift cards. prosecutors also say he spent nine nights in hilton hotels paid for by pg&e. >>> the off again on again execution is now off again and it will be for some time. albert greenwood brown was scheduled to be put to death tonight. it would have been california's first execution in nearly five years. but the state supreme court denied a request by the state to begin using new procedures for lethal injection. now the state won't be able to execute brown until 2011 because california's supply of lethal injection drugs expires tomorrow. a new supply won't arrive until next year. >>> a bay area mom is

declared a state in the state and the governor's of virginia and maryland have also declared states of emergency. other atlantic coast states are preparing as well for potential effects from the storm. >>> it is 5:05. it is going to be another warm one around here but it's also a "spare the air" day. let's look at day 2 of the mini heat wave. lawrence? >> kind of nice to have the heat around the bay area. haven't seen much of it all summer long. step out the door right now and those temperatures are already very mild to warm all around the bay area. we have numbers well into the 60s, inland under clear skies. clear as a bell inside the bay and even at the coast, no fog to speak of. that's a good sign that we're headed for another very warm day around the bay area. going to be hot in many spots again inland. probably going to top out about 103 degrees in some of the hottest spots. you get inside the bay, yeah, it's going to be on the warm to hot side, as well. mid-80s to mid-90s in some of the warmer areas. at the coast, head to the beach, probably one of the nicer beach days all sum

headquarters tonight. thanks. our other big story is hurricane earl. the governors of north carolina, virginia, and maryland have declared states of emergency as the storm moves closer and grows stronger. it is a category four again with 135 mile an hour winds and it cuts an imposing image in the latest photo from space. at last report, earl was about 600 miles south-southeast of cape hatteras, north carolina. it could reach there late tomorrow or early friday, then roll up the east coast. hurricane watches and warnings are up as far north as cape cod. kelly cobiella is in kill devil hills, north carolina, tonight and has the latest. kelly, good evening. >> reporter: good evening, harry. despite a picture-perfect beach day here, some tourists and locals alike on the most remote of the islands spent it packing up because hurricane earl's winds and rain could be close to this coast in 24 hours. if there was any doubt about hurricane earl's power, these postcards from the caribbean should erase it. the storm caused at least $150 million in damage from the virgin islands to puerto rico, cut power
